AGREEMENT TO OUR LEGAL TERMS We are Jack Ward, doing business as JackiePoot Creations and JackiePoot ("Company," "we," "us," "our"). We operate the mobile application Cuppi (the "App"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Jack Ward, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms.

IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Minors and Parental Consent The Services are intended for users who are at least 13 years of age. Users under the age of 18 ("Minors") must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a Minor, you must have your parent or guardian read and agree to these Legal Terms prior to you using the Services.

1. OUR SERVICES & GEOGRAPHIC RESTRICTION The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation.

UK Exclusivity: The App is intended solely for users residing in the United Kingdom. We make no representations that the Services are appropriate or available for use in other locations.

2. INTELLECTUAL PROPERTY RIGHTS We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the "Content"), as well as the trademarks and logos ("Marks").

Your Licence: Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable licence to access the Services and download or print a copy of the Content solely for your personal, non-commercial use.

3. USER REPRESENTATIONS & SECURITY By using the Services, you represent and warrant that:

  • All registration information you submit will be true, accurate, current, and complete.
  • You will maintain the security of your account, including any 2-Step Verification (TOTP) codes or authenticator apps used to secure your profile.
  • If you are a Minor, you have received parental or guardian permission to use the Services.
  • Your use of the Services will not violate any applicable UK law or regulation.

4. CUPPI PRO PURCHASES AND SUBSCRIPTIONS

  • Billing: Payment for Cuppi Pro will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew (monthly or annually) unless cancelled at least 24 hours before the end of the current period.
  • Household Sharing: A Cuppi Pro subscription acts as a "Master Key." The purchasing user (the "Owner") unlocks premium features for all active members of their single connected Household. We reserve the right to restrict or revoke subscription benefits if we detect abuse of the Household system (e.g., rapidly hopping between multiple households to grant unauthorized premium access).
  • Refunds: All transactions are processed by Apple. We do not process refunds directly. You must contact Apple Support for refund requests.
  • Free Trials & Offers: Any unused portion of a free trial period or introductory offer will be forfeited if you change your subscription tier.

5. AUTOMATED FEATURES ("THE COMPANION") The App includes an automated feature known as the "Companion" which generates monthly overviews, smart posts, and reminders based on your household's inputted data.

  • Not Generative AI: The Companion uses deterministic programming to organize your data. It does not utilize generative AI, Large Language Models (LLMs), or external AI servers to write these updates.
  • Accuracy: The Companion relies entirely on the accuracy of the data you input (e.g., bin collection dates, pet medication logs). We are not responsible for missed reminders caused by incorrect data entry.

6. FINANCIAL AND HEALTH DISCLAIMERS

  • Financial Data: The Budget and Receipt features are provided for informational and personal tracking purposes only. We are not financial advisors. We do not guarantee the accuracy of OCR receipt scanning, and you should not rely on the App for tax, legal, or professional accounting advice.
  • Pet Health Data: The Pet Medication and Vaccination tracking features are for convenience only. We are not veterinarians. You must always consult a qualified veterinary professional for your pet's medical needs and rely on their prescribed schedules, regardless of the reminders generated by the App.

7. PROHIBITED ACTIVITIES & COMMUNITY CONDUCT You may not use the Services for any purpose other than that for which we make them available. Prohibited activities include:

  • Attempting to reverse engineer, decompile, or disassemble the App's proprietary software.
  • Creating multiple anonymous accounts to abuse free-tier limits or bypass rate limiting.
  • Harassing, abusing, or harming other users within the App or on the connected Cuppi Community Forum. We reserve the right to suspend users who violate community guidelines.

8. USER DATA & CLOUD SYNC We maintain certain data to provide cloud synchronization and multi-device access.

  • Our Responsibility: We perform regular backups of cloud-stored data. In the event of data loss caused by our gross negligence, we will use reasonable endeavours to restore such data.
  • Your Responsibility: You are responsible for any data you transmit. Except as required by UK Consumer Law, we are not liable for data loss or corruption.

9. TERM AND TERMINATION These terms remain in effect while you use the Services. You may delete your account at any time via the Profile settings. We reserve the right to terminate your access for a material breach of these terms. If you delete your account, you have a limited window to restore it before your data is permanently deleted from our servers.

10. LIMITATIONS OF LIABILITY Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law. Subject to the above, our total liability to you for any claim arising from the Services shall be limited to the amount paid by you to us (if any) during the six (6) month period prior to the cause of action, or £50, whichever is greater.

11. GOVERNING LAW These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the non-exclusive jurisdiction of the courts located in London.
